This publication is a guide for Practitioners that helps them understand the implications of migration to electronic records and the enhanced privacy and security rules that accompany ARRA and the HITECH Act. The Survival Guide (SG) attempts a “forest from the trees” overview of the HIPAA Privacy and Security rules, and also includes a general overview of the HITECH Act as it pertains to these rules. Carlos and Deborah Leyva chose to write about these rules from a practical perspective because the Obama administration's push for electronic health records (EHRs) will shine a new light on HIPAA compliance. This effort began as a tool for our own use and we subsequently decided that the community at large might benefit as well. This guide is not intended to be legal advice, nor is it a fully comprehensive legalistic interpretation of the new regulations.
